Facing a police arrest can be intimidating, but knowing your rights can help you stay calm and protect yourself.
You are not required to answer questions beyond identifying yourself. Politely state, “I wish to remain silent,” and do not share additional details without your lawyer present. Anything you say can be used against you, so it is wise to stay quiet until you receive legal guidance.
If you are arrested, you have the right to speak with a lawyer before answering questions. You can say, “I want to speak to a lawyer,” and the police must stop questioning you until your lawyer is present. This ensures your rights are protected during any interrogation.
Even if you believe the arrest is unfair, do not resist. Resisting can lead to additional charges and may escalate the situation. Stay calm, keep your hands visible, and avoid sudden movements.
You have the right to know why you are being arrested. You can calmly ask, “Am I under arrest?” and “What am I being arrested for?” This helps you understand the situation and prepare for your legal defense.
If it is safe to do so, try to remember badge numbers, patrol car numbers, or the names of the officers involved. If there are witnesses, get their contact details if possible. This information can help your lawyer later.
